Terms of Service

Welcome to Coocat (coocat.in). These Terms of Service ("Terms") govern your access to and use of the Coocat website, customer application, and related services (collectively, the "Services").

By creating an account, placing a booking or inquiry, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Coocat operates a marketplace that connects customers with independent caterers, cooks, and related food-service providers ("Providers") across Gujarat, India. Coocat is not itself the caterer or cook for bookings fulfilled by Providers, unless we expressly state otherwise for a specific offering.

• You must be at least 18 years old to create an account and use the Services.
• You must provide accurate, complete, and current information when registering and when submitting bookings or inquiries.
• You are responsible for safeguarding your account credentials and for all activity under your account.

You may register using email/password, phone OTP, or supported third-party sign-in (such as Google). You agree not to share your login details or impersonate another person. We may suspend or terminate accounts that violate these Terms or appear fraudulent, abusive, or unsafe.

• Prices shown on the platform are indicative or quoted by Providers (or by Coocat for Coocat-operated offerings) and may change based on guest count, menu selections, date, location, taxes, or custom requests.
• Payment may be collected through Coocat, directly by the Provider, or a combination, depending on the booking flow. You agree to pay all amounts due for confirmed bookings.
• Applicable taxes, service charges, delivery, or other fees may apply and will be disclosed where reasonably possible before confirmation.

Cancellation and rescheduling rules may vary by Provider and booking type. Where a specific cancellation policy is shown at booking time, that policy applies. Otherwise, cancellations and refunds (if any) are handled case by case with the Provider and/or Coocat support. Please contact us promptly if you need to change or cancel a booking.

You may submit ratings, reviews, photos, and other content. You grant Coocat a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with the Services. You agree not to post content that is false, defamatory, unlawful, or infringes others' rights. We may remove content that violates these Terms.

You agree not to:

• Use the Services for unlawful, fraudulent, or harmful purposes.
• Harass Providers, other users, or Coocat staff.
• Scrape, reverse engineer, or disrupt the platform, APIs, or security measures.
• Bypass fees, create fake bookings, or manipulate ratings and reviews.
• Upload malware or attempt unauthorised access to accounts or systems.

The Coocat name, logo, website design, software, and marketplace content (excluding user and Provider content) are owned by Coocat or its licensors. You may not copy, modify, or use our branding without prior written permission.

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that Provider listings will always be accurate or available.

To the fullest extent permitted by applicable law, Coocat and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services or from Provider-fulfilled bookings. Our total liability for any claim relating to the Services shall not exceed the greater of (a) the fees you paid to Coocat for the specific booking giving rise to the claim in the three months preceding the claim, or (b) INR 5,000.

Nothing in these Terms excludes liability that cannot be excluded under applicable Indian law.

Our collection and use of personal data is described in our Privacy Policy. By using the Services, you also acknowledge that policy.

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure for us or others, or if we discontinue the Services. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

We may update these Terms from time to time. When we do, we will revise the Effective Date above and, for material changes, provide notice via email, in-app message, or a website notice. Continued use of the Services after the updated Terms take effect constitutes acceptance of the changes.

These Terms are governed by the laws of India. Subject to applicable law, courts in Ahmedabad, Gujarat shall have exclusive jurisdiction over disputes arising from these Terms or the Services, without prejudice to any mandatory consumer protections that may apply.
